VPS Hosting Terms of Service

VPS and cloud compute services work differently from our managed hosting products: you get root access and full control of your own operating system, and that changes what we can reasonably promise around backups, security and support. These Terms cover VPS and cloud compute specifically. They sit alongside, and take priority over, our general Terms of Service where the two differ. Definitions from clause 1 of the general Terms of Service apply here too.
The VPS Hosting Acceptable Use Policy and VPS Hosting Service Level Agreement form part of this agreement.
1. What we manage, and what you manage
1.1 We manage the physical hardware, the hypervisor, the network, power, and the DDoS protection sitting in front of your server.
1.2 You manage everything from the operating system upwards: the OS itself, security patching, installed software, firewall configuration, and anything you run on the server. Because you have root access, we cannot see inside your server or be responsible for what happens there, except where the underlying platform itself is at fault.
1.3 We provide support for platform-level issues: the network, the hypervisor, hardware, and your account. We do not provide operating system administration, software installation or application support as standard, though our team can advise where we reasonably can.
2. Billing
2.1 VPS and cloud compute plans are billed monthly in advance, with no minimum term. You can cancel at any time and the service will end at the close of your current billing period.
2.2 Clauses 7.1 to 7.6 of the general Terms of Service apply to billing, pricing changes and payment.
2.3 There is no money back guarantee on VPS or cloud compute services. Because you receive root access to dedicated resources immediately on provisioning, we are not able to offer the 30 day guarantee available on our other hosting plans.
3. Resizing and rebuilding
3.1 You may resize your server to a different plan size at any time from your control panel. A resize keeps your data, your IP address and your operating system, and requires a reboot.
3.2 You may rebuild your server onto a different operating system template at any time. Rebuilding erases everything on the server. You are responsible for backing up anything you want to keep before you rebuild.
4. Backups and snapshots
4.1 Snapshot tools are available so you can capture the state of your whole server before making a risky change, and roll back to a snapshot if something goes wrong.
4.2 Snapshots are not a substitute for an independent, off-server backup. They are stored on the same underlying platform as your server, and we do not guarantee their availability, integrity, or that a snapshot will restore successfully in every case.
4.3 You are responsible for keeping your own off-server backups of anything you cannot afford to lose. We strongly recommend this for any server running production workloads.
4.4 We do not take backups of your server on your behalf as standard. Where we do run any of our own operational backups for business continuity purposes, these exist for our own use and create no obligation to you.
5. Security
5.1 Because you control the operating system, you are responsible for keeping it patched, for configuring your firewall, for securing any exposed services, and for anything that happens as a result of software you install.
5.2 If we detect activity from your server that is harmful to our network or to others, such as participation in a botnet, outbound attacks, or a compromised service, we will contact you and may suspend the server under the VPS Hosting Acceptable Use Policy while it is addressed.
6. Suspension and termination
6.1 We may suspend your server immediately where required under the VPS Hosting Acceptable Use Policy, or where payment is overdue, in accordance with clause 7.7 of the general Terms of Service.
6.2 Clauses 10.1 to 10.4 of the general Terms of Service apply to termination. On termination, your server and any snapshots are deleted; there is no extended retrieval period for VPS data given the nature of root-access infrastructure, so please take your own copy of anything you need before cancelling.
7. Liability
Clause 12 of the general Terms of Service applies. In addition, we are not liable for any loss arising from your management of your own operating system, software or data, including loss caused by a failed snapshot restore, except to the extent that loss was caused by a fault on our own platform.
8. Everything else
Clauses 1 to 3 (definitions and how the agreement forms), 6 (acceptable use), 9 (general suspension principles), 13 to 16 (indemnity, intellectual property, data protection and changes to these terms) and 18 (general provisions) of the general Terms of Service apply equally to VPS and cloud compute services.
